DISTRICT COURT NEWS

The following cases have been heard in the Allamakee District Court:

Erik Selberg -
Erik Kevin Selberg, 20, Waukon, was charged with two counts of terrorism and one count of 4th degree criminal mischief.
According to court affidavits, Selberg was pulled over by an officer on the evening of Dec. 2, 1999, after a resident reported gunshots being fired into their home. Selberg admitted to being involved in the incident and another one of similar circumstances a few months earlier at the same residence.
Selberg was sentenced to ten days in jail with restitution to be determined and fined $250 on the 4th degree criminal mischief charge. Sentencing for the two counts of terrorism included five years in prison, with the sentence being suspended upon service of five years probation to the First Judicial District Department of Correctional Services. He was also fined $750.

Joseph P. Palmer -
Joseph P. Palmer, 52, of Waukon, was charged with operating while intoxicated (OWI), first offense, in relation to a May 31, 2000, incident.
Upon receiving report of a vehicle parked in the streets, officers arrived and reported a heavy smell of alcohol. The defendant admitted he had been drinking alcohol earlier in the night. He then failed a field sobriety test and was placed under arrest.
Palmer was fined $500 and spent two days in jail. He was also ordered to complete a course for drinking drivers within 60 days.

Adam Delphey -
Adam Palmer Delphey, 19, Waukon, was charged with possession of a controlled substance, namely marijuana.
Court affidavits show that last September the defendant was stopped at a residence. The owner of the residence had asked officers to remove any subjects from his home that were not his children. When the defendant was leaving the residence, officers noticed an overwhelming smell of marijuana. The officers asked to search the defendant and he complied. They found a small pipe and a baggy containing a green leafy substance that later tested positive as marijuana.
In court, Delphey was granted a deferred judgement. He is required to complete 70 hours of community service at a rate of $5.15 per hour to satisfy attorney fees.

Jesse Hitchcock -
Jesse Lee Hitchcock, 18, Waukon, was charged with operating while intoxicated, 1st offense, and operating a motor vehicle under license suspension.
The court affidavit indicates that at 11:45 p.m. on Sept. 17, 1999, officers were called to an accident near Frankville. Upon arriving at the accident scene, they discovered a truck had rolled into the ditch. The defendant admitted to being the driver. Alcohol was at the scene of the accident and the defendant performed and failed several field sobriety tests.
Hitchcock was fined $1,000, sentenced to two days in jail and had his license suspended.
Two weeks later, Hitchcock was see driving. He was known to have a suspended license and was pulled over by local police officers.
The defendant was fined $1,000 for driving with a revoked license.

Justin Larson -
Justin T. Larson, 20, was charged with 4th degree criminal mischief and two counts of terrorism after an incident occuring the evening of Dec. 2, 1999.
Officers received complaints on two separate occasions of shots being fired into private residences. A responding officer to the second incident stopped a vehicle, in which Larson was a passenger. A loaded, uncased weapon was observed on the floorboard of the vehicle. Both individuals admitted to shooting at the residence.
The defendant was sentenced to ten days in jail and fined $250 on the 4th degree criminal mischief charge. On the two counts of terrorism, he was fined $750 and was sentenced to five years in prison, with a suspended sentence. He was placed on five years probation to the First District Department of Correctional Services.

Ronald Fisher -
Ronald G. Fisher, 44, Sparta, WI, was charged with operating while intoxicated, 1st offense.
According to police records, Fisher was pulled over on Highway 26, May 6, 2000, after the Sheriff's office received a report of a potentially intoxicated driver driving a vehicle matching the defendant. The defendant smelled of alcohol and appeared to be under the influence. Fisher, not cooperative at that time, was placed under arrest.
In court, the defendant was fined $500 and was sentenced to 48 hours of jail time. He was also ordered to complete a drinking drivers course.

Reggie Schwartzhoff -
Reggie Floyd Schwartzhoff, 20, Dorchester, was charged with operating while intoxicated, 1st offense.
On March 25, 2000, a police officer responded to an automobile accident near New Albin. Upon arrival to the scene, the officer determined the driver to be Mr. Schwartzhoff. Schwartzhoff was transported to Gunderson Lutheran Hospital in LaCrosse because of injuries suffered during the accident. Officers invoked the Implied Consent Law and received a specimen of blood from the defendant. Upon testing, the defendant was charged with OWI, 1st offense.
The defendant was fined $1,000 and was ordered to complete a course for drinking drivers.

Todd Weber -
Todd Weber, 29, New Albin, was charged with domestic abuse in relation to a Feb. 26 incident in his home.
Weber was fined $500 and was sentenced to two days in jail. He must also complete a domestic abuse class within 90 days.

James Krause -
James Emmett Krause, 49, Waukon, was charged with assault causing injury, a serious misdemeanor.
Court affidavits show that the defendant assaulted a male victim with a knife in the French Creek area. The defendant also placed a gun to his face.
Krause was sentenced to 12 days in jail and fined $500.

Lucas Batteen -
Lucas James Batteen, 20, Lansing, was charged with operating while intoxicated, 1st offense.
Court affidavits show that the defendant fell asleep at the wheel and rolled his vehicle off Highway 9, landing upside-down. When police arrived at the scene, they gave the defendant a breathalyzer test, which he failed. Batteen was then placed under arrest.
In court, the defendant was sentenced to 48 hours in jail and fined $1000. He was also ordered to complete a drinking drivers course within 60 days.

Francisco Loera -
Francisco H. Loera, 36, Postville, was charge with operating while intoxicated, 1st offense.
Police records show that the defendant was parked in the middle of a drive when an officer approached him, turning on police lights. The officer noted a distinct smelled of alcohol. The officer then proceeded with an intoxylizer test, which he failed.
Leora was fined $500 and was ordered to complete a course for drinking drivers.

Nancy Neuzil -
Nancy Ann Neuzil, 25, Waukon, was charged with operating while intoxicated.
Court affidavits show that during a routine traffic stop, officers noticed a beer bottle on the vehicle floor and a strong smell of alcohol coming from the defendant. Officers administered field sobriety tests, which Neuzil failed.
Neuzil was sentenced to 48 hours in jail and fined $500. She is also required to successfully complete a course for drinking drivers within 60 days,

Jennifer Kohlmeyer -
Jennifer Jo Kohlmeyer, 31, Decorah, was charged with operating while intoxicated, 3rd offense.
Police reports show that the defendant was pulled over by an officer. Upon pulling over the defendant, the officer smelled alcohol and noticed that she had red, blood-shot eyes. The officer administered a breathalyzer test, which she failed.
Kohlmeyer was sentenced to 90 days in prison with all but 7 of them suspended. She was fined $1,500 and was committed to the First Judicial District Department of Correctional Services for 24 months.

Michael Sanders -
Michael David Sanders, 44, Lansing, was charged with assault resulting in bodily injury, 2nd offense as a result of a Feb. 5 incident in his home.
Sanders was sentenced to 30 days in jail, with all but two suspended and he was placed on one year of probation. The defendant was also fined $250 and required to complete a batterer's education program.
